Company A had applied for an RIR Labor app in Oct'2002. In Mar'06 we got a letter saying that case was closed. Then the attorney asked it to be reopened and it was reopened. Then now end of Aug we got the approval.
Im in my 8yr of extension based on this RIR.
Ok since then in early 2004 Company B bought Company A. Then in Mid 2004 Company C bought Company B. Attorney at that time said i dont need to file any H1 and can stay in the H1 from Company A because it was a successor of interest !
but now the attorney is saying that it will be very difficult to prove this is a successor in interest and there is no way we cna get the I140 approved.
So..
1. What do you guys think ? Has anyone gone thru' something like this. Any ideas ? I have also applied for PERM with the current company.
2. How long can I continue without filing I140 for the labor that was approved.

Matter has been discussed in the past but i wanted to get an advice/opinion from seniors/pro.
How serious problem could be leave employer in the month you get green card who has sponsored you for immigration.
I am in this situation.

Hi Folks,
Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:
Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.
My questions are this:
1.) When I enter US back in with my AP in mid July will that impact my H1B extension in any way.
2.) Without any EAD will I be Jeapordizing my AOS in any way.
I will be continuing to work with the same employer who is the sponsor of my current
I485.
Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

Please let me know how do I convert TR labor pending in BEC to RIR.
Accoding to recent law, I know that we can do it
My original application was filed under RIR and my RIR has been rejected and my LC went back to TR queue. I also know that you can again convert back to RIR from TR even if original RIR is rejected.Blood $uckers took 4 years to tell this.

My cousin who came here on H4, found a company that sponsored her H1-b and she was working as a consultant to a big firm. She had to return to home country last year, and she had to get her papers stamped - which was denied.
she continues to work for the same firm from India. She has a house in the US, that she has put on market, and continues to pay the mortgage. Does she realistically have a chance of returning to the US on H1-B?

Hi ,
My husband has a conviction for domestic violence. he was not jailed but is under probation. he is on h1b visa and i am on h4. his i140 was approved before the conviction. also both our visa extension were approved prior to that. currently visa stamp in both our passport has expired but we have valid i-94. i need to visit india for urgent family health issue. if i go i will need to get a new stamp. Can his arrest result in my visa getting denied at consulate. Or will it create any problems for me at port of entry?. he is not going to travel with me

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

I am silent visitor of this forum for last few months though, I seek some advice form you guys in forum. I just got I140(On May 5th 2008) approved and my priority date 23rd Jan 2004. As per the visa current bulletin I am with in the cutoff dates. I have job offer but I did not accept so far because I 140 was not approved but after I 140 I thought of changing the job (same offer) using AC21 portability, since I fall in current cutoff dates,
My question is this safe to change the job when priority date fall with in current cutoff dates?
GOT RFE on I 140 on Apri 1st 2008

I have B1/B2 Visa for 10 yrs and travelled to USA earlier and also planning to VISIT USA on B1/B2 Visa in the last week of July for just 10 days.
The doubt is that - "since I have H1B Visa CASE APPROVAL, can I travel to USA on B1/B2 Visa"
Someone suggested that I can travel but it is NOT ADVISABLE!!
