My I-485 is pending(EB-3,India)since 2007. I changed employer & successfully ported PD on new I-140 approval in EB-2 category. My PD is in Oct 2006 & I expect that to become current in the coming few months.
Now, I need to do Interfiling to link my pending I-485 to my new I-140.
(1) What all documents/wordings are required for interfiling? Can someone pls provide a checklist?
(2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?
(3) Can I send my Interfiling request to USCIS even before my PD becomes current?

I also have the same status. I think it has to do with finger printing when had filed for 485 during July 2007. My status is like that since Dec 2007 .Nothing has changed after that for me..

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
The 140 approval notice is not required unless this is a post six year transfer/extension.

Why do you say tranfer will be denied if extension petition is withdrawn? Are they not seperate applications filed by 2 different companies?

1.Did anybody have recently got H1B stamping done in Hyderabad consultate.
2. Any issues with getting appointment dates.
3. I have all the documentation in place including pay stubs in the last 8 years.
4. Is it preferable to get stamping done in Canada than in Hyderabad,
5. How many days does it take to get the passport back.
Please share me your experiences,

You should speak to an immigration attorney. That's the best I can tell. False claiming to be a U.S. Citizen can lead to a permanent inadmissibility to the US. As such, it is a serious matter and should be discussed with an attorney.

I selected H1B: SPECIALITY OCCUPATION as that was the manner i last entered the country in Dec 2007. Even though i have an AP(haven't used it) but for my wife(who entered on AP) i selected DA: Advance parole. So if you used AP at POE then your status is DA. Hope that helps :)

Guys,
I just got my approval (Mar 06, TSC), finally! The key issue that I am facing is that I am not in US at the moment and it is very difficult for me to return immediately.
1. Is it okay that I come back after a month or so?
2. Secondly, my AP is expiring later this month though I have H1B stamped till next year. The issue is that earlier this year I had used AP to enter US in spite of the fact that I had a valid H1B. DOES this invalidate my H1B visa? Can I use the H1B visa to enter US after my AP expires???
Is there anything else I can do such as getting the cards fedexed to me and use them to enter US?
Experts pl. advise�
