Dear Fellas,

I went for H1b Stamping a couple of months back. I was given a 221 g at that time and later on was asked for company's tax documents. During this time I did not hear any thing from US embassy in islamabad and got the same reply that my case was under administrative processing.

yesterday I received a letter from US embassy saying that my petition was returned to INS. The whole process has been very frustrating and I even left a couple of good offers hoping that H1b will get through anyways I guess its over for me now......

Did any one else face the same situation?? Will it do any good to reapply?

Sorry to hear about it. Don't get discouraged though, you will find new offers soon, just keep trying. Remember that persistence creates luck. About the reapplying for visa, I guess you should first talk to your company about it and then with the lawyers who helped prepare the documents. I guess, that'd be good place to start with. In the mean time, keep an eye on the opportunities in your home country. Good luck.

On paper, the D2X looks really great and certainly meets my expectations. Only time and testing will tell and I'll wait for the verdict to come in before I buy one. However, I'll be saving my pennies in anticipation that this camera will perform well. Nikon has not released any price information to their dealers but one told me to expect this puppy to be in the $4000 - $5000 price range.

If this is as good as it looks perhaps Nikon users will be in the same boat as Canon users when it comes to finding new and used lenses. Now might be the time to pick up some good "surplus" Nikkor lenses that are all over the place.

I see that the D2X will be using a CMOS sensor instead of a CCD. As a relative neophyte to digital photography I'm curious as to why they did this.

Anyway, these are exciting times and this is exciting news. Hopefully the D2X will be a superb performer and I'll only have to buy the body instead of changing brands and having to buy everything all over again.

Today my lawyer sent me my receipt numbers for 485, EAD and AP. when I enter my AP receipt number to check online status I see the following...

Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION

Current Status: Card production ordered.

On August 30, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

Anyone know what this means... It doesn't say I-131 in application type..

Second disturbing thing I noticed when I entered my 485 number...

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Fingerprint fee rejected and notice mailed; case in suspense.

On August 23, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense. Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.

My lawyer says the checks have been cashed and we have proof of this.. She says it can be a typo..
Most weird part is for my EAD it says card has been ordered.. but I haven't even done finger prints and my 485 is in suspense..

Anyone any idea whats happening.. should I be worried about OS155A and 485 things..

Guys,

Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?

She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.

We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.

My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?

A lot of you may have experienced the same dilemma, so please let me know...

Hello All,

If my priority date is current as of November bulletin, do I have time
until 30th November to mail the I-485 application?

Or does the DOS need to have received the application on or before 30th November?

And if I am in California, where does the I-485 application physically go?

[Its a long story why I didn't when the doors were open in July-Aug]

It has limited relevance, the issue is the integrity of the Senator, he has admitted to the issue at hand but he went on the Senate floor as an elected public official to make declaratory and restrictionist anti-immigration statements, attacked immigrants, proposed and supported anti-immigrant ammendments and all this with the foundation of his positive public image, integrity and moral uprightness. We are thus not discussing the list he is on, but are simply taking note of the Senator's credibility on an issue that affects us. Anything beyond that would be inappropriate and not relevant to our issues.

Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

I got a card production email on 6/25, got the 485 approval notice in the mail on 6/27 but haven't received the card yet as of today, 7/1. Anyone seen this sort of long delay in getting the card?

Well, everyone should be proud of IV's great volunteers too who have always proved their consistent success from time to time - though big sucess yet to come! As these volunteers are just like one of us who are working full-time in their job and contribute to IV as and when they can - but I always felt that IV is managed by bunch of full-time professionals with so efficient and accurate manner! Their leading efforts to solve legal immigrant's problems are really commendable!! We are equally graced with great IV members who contributed $$ generously every time (and hope they will keep continue) and helped other way too (e.g. live update of senate sessions, news links, new immigration bills, etc...).

Thanks to everyone. Really proud of being IV member. United we stand!

Hi ,

I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.

I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.

b. I know that 3 yrs extension is possible with approved I-140. Is it possible with new employer also (the one who has nt filed ur GC ? Also Is 3 yr extn possible after filing I-485 beyond 6 yrs?

Hi,

I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
Now i need to visit to india so
1) Will there be any problem to get stamped in india if i travel in April ?
2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
3) Which one is less risky (going to mexico or canada) ?

Please let me know ASAP. I appreciate your help on this.

In a recent decision, RUIZ-DIAZ v. UNITED STATES OF AMERICA, the court ruled that Petitioners who filed or will file a Petition for Special Immigrant Religious Worker Visa (Form I-360) with United States Citizenship and Immigration Services (�USCIS�) on behalf of individual beneficiaries are hereby notified that you or your beneficiary may now file an Application for Adjustment of Status (Form I-485) and, if your beneficiary seeks employment status as an adjustment applicant, an Application for Employment Authorization (Form I-765) even if USCIS has not yet issued a final administrative decision regarding the I- 360 petition. Previously, the I-360 had to be adjudicated before the adjustment package could be filed.

The Court has invalidated USCIS� bar against concurrent filings as an unreasonable
interpretation of the governing statute. Pursuant to an order dated June 11, 2009, USCIS is required to accept as properly filed adjustment of status applications (Form I-485) and employment authorization applications (Form I-765) from individuals who are beneficiaries of petitions for special immigrant visas (Form I-360 (http://www.h1b.biz/lawyer-attorney-1137192.html)), whether submitted concurrently with or subsequent to the visa petition, provided the applications meet USCIS� valid filing requirements.

Bear in mind that this decision may be subject to Appeal, so things can still change. But for now this is a victory to the applicants filing under this category.

certainly there is a possibility for delay with pretty much anything that involves immigration. when does your current H1 expire? Even if it expires since you have a pending application, the reciept notice would possibly suffice to continue in legal status. I am definitely not an expert. Others might provide better idea.

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?
As far as I-94 goes it will expire but since you are already in AOS status, it really does't matter.

You do not need new visas. At port of entry show the new approval notice to get I-94 for the duration of the new approval notice.

My husband is in H1B visa and he transfered his visa to another company. Got the I-797 approvals too. Along with that mine and my kids H4 also got approved.

Now I am urgently required to travel to India, and want to return from India without going for stamping. Here are other details.

1) Even my previous H4 visa is not expired while I return from India.
2) I have the new H4 approval notices and copy of husbands new H1s I797 with me.

Will it be an issue if I reenter without stamping. Our plan is to go for Visa stamping to any nearby consulate in US border after I come back. Please advise.

She also met with law enforcement leaders to discuss the Department�s efforts to support state, local and tribal law enforcement in protecting communities from cross-border threats. She said, "Over the past year and a half, this Administration has pursued a new border security strategy with an unprecedented sense of urgency, making historic investments in personnel, technology and infrastructure while combating transnational criminal organizations that smuggle weapons, cash and people across our shared border with Mexico.� She said that Operation Stonegarden is one part of our overall strategy to provide state, local and tribal law enforcement on the frontlines the resources they need to confront the complex and dynamic challenges that exist along our borders.

The fiscal year 2010 Operation Stonegarden grants�totaling $60 million nationally�support 15 border states and the Territory of Puerto Rico to enhance the capabilities of federal, state, local and tribal law enforcement agencies to secure U.S. borders and territories. Funds were allocated using CBP�s sector-specific border risk methodology based on threat, vulnerability, miles of border and border-specific law enforcement intelligence. Nearly 80 percent of the fiscal year 2010 funding will go to Arizona, California, New Mexico and Texas�up from 59 percent in 2008. Operation Stonegarden grants can be used to support law enforcement personnel, overtime, and other related costs to increase operational readiness.
