    I received my AP for the entire family thru' my lawyer and USCIS webpage is still showing that my 131 is in progress and case pending???
    Hope it should not happen to the final GC!

    I am not 100% sure about this issue but� I do see couple of emails from attorneys regarding denying port of entry in NJ airport. If you come across of any cases please share.

    Hi everyone,

    I received an RFE for my I-140 application from the Nebraska Service Center around the requirement for my Master's degree. I had completed all the necessary course work in Spring 2003 and have official letters from the director of the dept stating that I have completed my course requirements and will graduate in 2003. As luck would have it - there were major administrative delays and I finally got my degree in 2006.

    My lawyer is concerned that in responding to the RFE - I might get a denial since the requirement was a Master's degree. But I have letters and on my official transcripts - it clearly shows that the last course work I attended in school was in 2003.

    I am confused and feeling helpless since I am afraid that I will get a denial and will need to restart my entire process from scratch.

    Has anyone been in a similar situation and gotten past it OR does someone have any ideas on how to get around this and come up with an RFE response that will get me the I-140 approval (EB2)?

    What makes it worse is that I already have the AP and EAD documents for myself and my spouse approved in hand.......and am hoping that I do not go through this ordeal all over again - this is the 3rd time I am going through the entire process - the first two times was because of company layoffs.

    1) Since she doesn't have any paystub/w2, is it possible to do COS?
    She doesn't need a paystub to change from H-4 to H-1B. In fact, a paystub would hurt since she should not be working in H-4 status.
    2) If #1 is okay what are DOCs she or me (if applicable) has to provide.
    The employer's attorney will tell her what documents she needs to probe her current status.
    3) How long does it take to complete the COS if done by PP.
    PP guarantees a response in 15 calendar days
    4) How much risk does this case carry/what are the issues she could face?
    What type of risk do you worry about? I don't see any more risk here than in any other H-1B petition.

    your wife is exempt from EAD/AP fees. If you apply online for her EAD or AP, the system will automatically figure that out and will not charge anything additional

    Our GC journeys have spanned 2 recessions and we could not even take advantage of the slight boom in the middle...how pathetic.

    Dates were current till 2005. They were again current in between.
    So it has been a game of luck. Many people got GCs and may even have citizenship by now. Until 2005 your luck depended on the state your labor was filed from.

    CIR is impossible with the current Congress, any legislator thinking it is a possibility is only misleading!

    "That" legislator also knows it is impossible. He/she is doing it for a poltical stunt so that he/she can go say I did try from my side.

    My belief is that this time around they will try a Dream Act - SKIL Bill combo meal to get some votes in Senate/House

    38mm is still very much in the "normal" range for a 35mm format. The usual guidline has been that the focal length of the "normal" lens should be approx. the same as the film diagonal. If you were to crop your image to 8 x10 proportions from a 35mm image the diagonal would be 38.4mm.

    So you are good to go. This means, when the company applied for your H1, they also applied for your wife's extension using form I-539.

    When your wife presents the I-797 in her name, a new I-94 will be given upto 12/25/2009.

    There are few cases, where out of ignorance or negligence, they do not apply I-539 while applying for H1, thereby jeopardising h4 status.

    In your case, it has been done right. so no worries.

    Barking dogs seldom bite. He is just another Lou Dobbs Please ignore him. There is no way he can change the right to cictizenship for children born in the USA. It is next to impossible since it is a part of the constitution. It is very difficult to change something that is linked to the constitution. So, ignore this "BARKING DOG."
    Just on the lighter side...
    Definitely not when biting!!!..

    Hey, this is MY thread and I will delete any argumentative posts about sports teams :)

    I personally don't root for any team. Not much of a sports fan.... odd really considering every guy in my family is, but then again I am nothing like anyone else in my family... so that could be why.

    Hi,
    My H1b visa stamp is of Company A with expiry date Dec 1, 2007.

    I work for company B. I have gone back to India and came back with company B�s 1797 and company A�s visa stamp last year (October) without any issues. So we can come back on our previous H1 B visa stamp if we have a valid 797 with us at the port of entry.

    My question is below.

    Company B�s 797 is going to expire in Oct 24 2007 and I have to travel India during this time and will be entering USA again on November 11th 2007. I am soon going to apply for new 797 with 3 year extension with the same company (i.e B). Assuming I get the extension with 797 till Oct24 2010. Can I still enter USA(on Nov 11,2007) with the old H1B stamp pf company A (expiring on Dec 1,2007) and new 797 of company B(expiring on Oct 2010)

    I am also going to talk to my lawyer regarding this. Just in case if someone has anything to share with me, I will appreciate it.

    Really tragic, I noticed the cause of death was suicide by asphyxiation, they found a plastic bag around his head ?, that totally seems suspicious to me, an IITian will have a tons of job offers in India, so if finances were his problem that is ruled out, love problems ?, sad to see a 23 year old kid pass away like this.
